However, the condition of the husband, city and period are also taken in account in Mehr-e-Misl. Her mother's Mehr is not Mehre-Misl for her but only if she is from the same family, e.g. her mother is the daughter ofher father's paternal uncle. (Durre-Mukhtaar) TYPES OF MEHR Rule- There are three kinds ofMehr, 1 . Mehr-e-Muaj al The Mehr that is settled to be give before a woman's Rukhsati. In this kind of dowry, the woman has the choice of not being made Rukhsat before the amount is attained. IfRukhsat has already been made then she can stop herselffrom her husband to obtain this Mehr even ifbefore this Khalwat and Wati took place with her consent. Meaning the woman has this right always until the Mehr is obtained. 2. Mehr-e-Muaj 'j al The Mehr that is settled to be given by a specifIc time e.g. after 1 0, 5 , days I year etc. Before the time can expire, the woman does not have the choice ofasking for it but after it expires, she can demand it always. 3. Mehr-e-Muakhar The Mehr which is not mentioned to be given before or by a specific time. It was made absolutely and with obscurity which is generally what happens today. In this dowry the woman does not have the right to ask for it until Talaaq or death. (Fataawa Razvia, Alamghiri) The popular belief amongst the masses that without giving the Mehr, touching the woman is Haraam, is totally incorrect. 1 95
