A FEW MISCELLANEOUS MASAAIL Rule- Ifan engagement was made and sweetmeats, fruits etc came from the boy ' s side to the girl ' s but Nikah did not come to pass due to some reason, then if these obj ects were distributed and those who sent these things gave pennission to distribute them then they cannot take their items back. (Alamghiri) The pennission can either be explicitly given or gained through Vrf (common practice), e.g. in these areas, these things are sent so that the girl ' s family can distribute them amongst their other relatives. They are not given so that the girl' s people keeps or eats these objects themselves . (Bahare-Shariat) Rule- If a woman prepared some things for laheez from her parents wealth and own earnings and her mother passed away, then her brothers have no right to claim inheritance in that which is ascribed to their mother, if the father gave her those things in laheez. Similarly, if her father used to bring clothes and from them she used to gather items for her laheez then in the case of her father passing away, whatever she gathered ,no matter howmuch ,is all hers. (Alamghiri) Rule- If a man gives expenses to a widow in Iddat i n the hope that after it he will make Nikah to her, then iftheNikah takes place he cannot take backwhatever he haS spent. Ifthewoman refuses though, thenwhatever he gave her as Tamleek (property) can be taken back. Whatever was given as Ibaahat (it was not given in her property butfor her needs) cannot be taken back. (Bahare-Shariat, Tanweer) Rule- Adl is Fardh on a man who has two , three or fourwives, meaning all of them are to be equally seen to in their needs he has control over e.g. food, house, clothes etc. A Hadeeth states, "The person who has two wives but does not doj ustice between them will come on theDay of Qiyaamat with halfofhis body , vain anduseless."
