has implaced a separation ofpaths known as Talaaq. The literal meaning ofTalaaq is to leave but according to the Shariah, i t i s the division ofaman and woman from the contract ofNikah. In other words through marriage the woman becomes bound to the man and Talaaq (divorce) lifts it. Divorce is permissible in the Shariah but is the most despised ofall that is Halaal in the sight ofAllah £. Therefore the Shariah has implaced rules toj ustly governthe rights ofthose who are involved in Talaaq. Before a man commits himself' to giving his wife Talaaq, the Quraan and the Shariah urges him to ponder if this line of action is the correct one. Can the uneasiness between the husband and wife be alleviated? I f it can, then it should be done first before going down the route of the most despised Halaal act in the sight of Allah �. An earnest effort should be made to correct the grievances and problems present in the marriage so that the union oftwopeople can be saved from separation. When the problems cannot be resolved between themselves, then they should seek help from their respective families. A relative to advise, modify and correct the situation should be beckoned from their respective families. It is necessary on these relatives to sincerely attempt to rectify the wrong on any side and act in complete adherence to the laws set in the Shariah. However ifthis also fails and cohesion ceases, then the man is allowed to give Talaaq. Indeed the system of divorce implaced by the Shariah ensures that the rights of women especially are not trampled upon. A study ofthe Quraan, Hadeeth and Shariahwill testify to this. AN IMPORTANT NOTE Giving Talaaq is permissible but giving it without a Sharee reason is Makrooh and prohibited. If it is given though, then it will definitely occur. The man who gives Talaaq to his wife while she is in Haiz becomes a sinner but it will definitely occur. When there is a Sharee 1 98
