Rule- If a person forced a husband to write Talaaq and he wrote it but had no intention ofit at heart nor did he utter thewordTalaaq then it will not occur. By forcing is meant Sharee compulsion . Writing it bymerely being prompted to do so by someone or thinking that this person is an elder, how can his or her command not be acted upon, is not a valid Majboori (helplessness). (Raddul-Muhtaar) Rule- There are two types ofTalaaq, Sareeh and Kinaayah (according to the words ofTalaaq) . Sareeh are those words fromwhich the meaning ofTalaaq i s visible and apparent. These kinds ofwords in any language are used inTalaaq e.g. in English "I have left you" is Sareeh. One TaJaaq will occur due to it, wether there was Niyyat or not. Kinaayah are those words from which the meaning of Talaaq is not clear. These words are used in other meanings besides Talaaq. (General Books) Rule- Those words which have been reserved for Talaaq, when used in Talaaq, will cause one Talaaq-e-Raj ee to occur. However, those words which have not ben specified for Talaaq rather their usage gestures metaphorically towards it, when used, will cause Talaaq-e-Baain to occur, ifthere is Niyyat ofTalaaq or the situation points out that Talaaq is meant e.g. it was said in anger or Talaaq was being mentioned prior to it been given. (GeneralBooks) Rule- A woman being pregnant does not prohibit Talaaq from occurring as giving Talaaq during pregnancy is allowed and Halaal even if the husband had sexual intercourse with her during the period ofpregnancy. Now if Talaaq-e-Bain or Rajee was given and he did not make Rij at (take back) by mouth or touch his wife until the child is born, then after the child is born, the woman comes out ofhis Nikah and she now has the choice ofmaking Nikah with whoever she wants.
