If the woman is not Madkhoola then after the Talaaq of the first husband she can immediately make the second Nikah as there is no Iddat for her. (GeneralBooks) Rule- If i n the Ijaab and Qabool ofthe Nikah the following condition is made, i.e. After sexual intercourse, I will give Talaaq, then the Nikah is Makrooh-e-Tahrimi and the Hadeeth has cursed doing so. (In thecase of Halaala) the first and second husbands both and the woman will all be sinners even though the womanwill become Halaal for the first husband and the condition made will be Baatil (void) . The second husband is not Majboor to give Talaaq. If this condition was not made in the Nikah contract even though it was i ntended then there is no Karaahat (dislike) . Rather if done with a good intention then he is worthy of Thawaab. (Durre-Mukhtaar) EELA AND ZIHAAR Rule-Eela is when a husband takes an oath to not be intimate with his wife or to not be intimate with her for four months. There are two types ofEela, 1. Eela-e-ll1uwaqat- Eela offourmonths 2. Eela-e-Muabad- Eela inwhich fourmonths is not specified. 204
