Rule- The Iddat for death is 4 months, 1 0 days including the tenth night, wether the woman is a minor or adult, Madkhoola or not, or even if the husband is a minor. However the condition of this Iddat is that the woman should not be pregnant. (Jauhara) RlIle- The complete count of days for the above i s 1 30 days for a free woman. (Durre-Mukhtaar) IMPORTANT Nikah is exp l icitly Haraam i n N ikah. Marriage is far off, the Quraan has even classified sending a clear message for Ni kah during Iddat as Haraam. It also prohibited promising marriage after completing Iddat. The Shariah has only permitted to intend Nikah at heart or to say something adventitiously gesturing towards an intention to make Nikah after Iddat, not explicitly. Saying this adventitiously is permissible for a woman under Iddat ofdeath not for one under Iddat ofTalaaq according to the Ijmaa ofthe Ummat. Rule- The free Aaqil, Baaligh Muslim woman under Iddat ofTalaaq-e­ Rajee or Bain is not permitted to leave the home, at night or day even if the husband gives her permission to do so. A Naa-Baaligh girl under Talaaq-e-Rajee can go out but with the husbands consent, not without it. In the case of Bain-Talaaq a Naa-Baaligh girl can go out with or without permission. Yes, if she is near to become Baaligh then she cannot go out without pemlission. (Alamghiri, Durre-Mukhtaar) Rule- Until the Iddat ofTalaaq finishes, providing for the woman is the responsibility of the husband and she must complete the lddat in his home which was used by them before Talaaq. Due to the decline of Nikah, she should act as an Ajnabiyah woman and make purdah from the husband.
