When the husband agrees to the woman l iving in his home or provides another house for her, then it becomes necessary on the woman to immediately proceed to it and never come out of it until Iddat ends. (Raddul-Muhtaar) Rule- I f a woman went to her parents home with the permission of her husband and while there she gets news of her husbands death, then it is Fardh on her to immediately go back to her husband' s home the moment she gets news of his passing and remain there until the completion of Iddat. (Fataawa Razvia) Rule- Nafqaa (provision) is not waaj ib in the Iddat of death irrespective if the woman is pregnant or not. If the other inheritors of the deceased refuse to give it then they are allowed to do so. (Fataawa Razvia) Rule- The woman who goes away from the home without the permission ofher husband and was given Talaaq by him for this reason will not receive Nafqaa during Iddat. Yes after Talaaq, if she remains in the husband' s home and stops going out then she will be worthy of Nafqaa. (Alamghiri) CUSTODYAND RAISING THE CHILD The S hariah has implaced certain rules to govern the upbringing of children in an environment that supports character building. Children are b lessings of Allah � and should be given their proper rights not thought ofas hindrances in attaining wealth. Indeed by caring for them one gains Barkat, wealth is increased and not lessened. We now discuss a few ofthese rules. Rule- The right of bringing up a child is reserved by the mother, ircespective ofwether she is in Nikah or out of it. Yes i f her conduct is )improper, then the child will remain in her care until he or she is a child that does not understand.
