Rllle- The Nikah of a Murtad is absolutely Baatil. He cannot make Nikah with a Muslim, Kaafir, Murtad or any woman. (Alamghirz) Rllle- The Zabihah of a Murtad is in the same command of an animal that has died itself, even ifZabh was made with Bismillah. He cannot give testimony in any matter or become an inheritor to anybody. Similarly, his property is lost due to Irtidaad and whatever wealth is accumulated in the period of Irtidaad will not be inherited by the Murtad ' s inheritors. Yes, if the wife was given Talaaq and she was in Iddat when her husband became Murtad and was executed in this state, then si1e will become a Waaris. (Durre-Mukhtaar, Raddul-Muhtaar, Hidaaya) Rllle- Ifany Baatil deen was chosen, e.g. he or she became a Christian or Jew, then theMurtadwill only be classified as aMuslim againwhen hate and displeasure for that religion is demonstrated and Islam accepted. If any Zarooriyate-Deen was rejected, then until that particular belief or action is accepted and acknowledged again, the Murtad wi ll not become a Muslim even ifthe Kalima is professed. If a person became a Kaafir due to making Gustaakhi ofAllah Jt, and Rassoollalah �, the person will not be a Muslim until Tauba is made from that particular disrespect. (Durre-Mukhtaar, Raddul-Muhtaar) IMPORTANT NOTE To imprison and to execute a Murtad for not accepting Islam is the responsibility ofan Islamic ruler so as to stop the spreading of Fitna by such an individual. However, due to the fact that an Isiamic govemment is not presently found, new groups and sects have emerged. In a situation like this Muslims are to act upon the instructions ofthe Quraan and Hadeeth. We are ordered to socially and religiously boycott such sects and individuals and in doing so, lies the safety of our Imaan and beliefs. (Bahare-Shariat) 255
