RlIle- If anyone from the buyer or seller dies then (in the case ofBa 'ee­ e-Baatil and Faasid) the Hukm of Faskh sti l l remains. His inheritors officiate for him and they can make Faskh ofit. (Durre-Mukh taar) A FEW EXAMPLES OF BA'EE FAASID AND BAATIL RlIle- A Thamn (price) not being mentioned in the Ba' ee meaning the ­ seller says to the buyer "Give me its market rate" is Ba'ee-e-Faasid and saying "There is no Thamn" causes Ba'ee-e-Baatil as Ba'ee cannot take place without Thamn. (Durre-Mukhtaar) RlIle- Ba ' ee ofmilk in the teat, wool on the sheep which has not been fleeced yet and Ghee that has not already been extracted from milk is all impermissible. (Durre-Mukhtaar) RlIle- Making Ba'ee ofwater that is stil l in a well or river is not allowed but when it is filled into a j ug or another vessel then the person who fills thej ug becomes it' s owner and he can sell it. (Alamghiri) RlIle- Selling human hair is not correct and to use it is not allowed meaning it is Haraam for women to make an extension or bun with it and use it. The Hadeeth has cursed doing so. (General Books) BENEFICIAL NOTE If a person has the Baal-Mubaarak (BlessedHair) ofthe Holy Prophet � and another gives him a gift and takes it then this is correct on condition that it is not done as Ba' ee. Also, to attain Barkat from the Baal-Mubaarak, to drink the water used to wash it, meaning the water blessed by touching it, to pass it on the eyes and giving it to the sick to drink for the purpose of Shifaa, are all correct and proven from authentic and Sahih Ahadeeth.
