3. Without Qabza, the merchandise does not become owned in Ba' ee-e­ Faasid and in Ba' ee-c-makrooh even before Qabza, the buyer becomes the owner. (Durre-Mukhtaar, Raddul-MlIhram) RELATED MASAAIL Rule- Ba'ee is Makrooh-e-Tahrimi from when the Azaan of Jumaa begins until the end ofNamaaz andAzaar: here, is meant the firstAzaan as preparations for the prayer becomes waajib with it. The aim ofdoing so is to create inclination for the goods within the buyer so that he buys it for a higher price. This is only deceiving the buyer. Describing the Mabee to the customer with qualities that are unfound in it so that the buyer is deceived, is also Bakhash. (Hidaaya) Rule- If the buyer wishes to pay less than the appropriate price then it is not impermissible for anotherwho is not going to buy, to infl ate the cost until the suitable price. The reason for this is so that benefit, not hann is attained. (Raddul-Muhtaar) Rule- Auction sale known as "Ba' ee may-Yazeed" is allowed and this type ofBa'ee is proven from the Hadeeth as well. To break the business deal between two people is prohibited, e.g. if the buyer and seller have both agreed on a price and only handing over the merchandise or Ijaab and Qabool remains, then it is not allowed fcr a third party to come and give an increased amount of payment. This also applies to sellers as well, e.g. offering the customer a lower price for the same merchandise agreed at another's shop . (Fathul-Qadeer. Raddul-Muhtaar) Rule- Rassoollalah � has not allowed " Talaqqil-Jalab" meaning to go out to the traders before they enter the city or town and purchase their gram. 275
