Rule- It is permissible for the people who have care and custody ofsmall children to buy and sel l with their property, things which are necessary for them. However only objects of need , not unnecessary things, are to be bought. Otherwise, they will be accountable for their squandering. (Durre-Muktam: Raddul-Muhtaar) QARZ Taking and glvmg Qarz (a loan) to complete a need are both permissible. It has been reported in the Hadeeth that the Holy Prophet � took a Qarz, paid it back when he received some money and gave the fol lowing Dua, "MayA llah grant Barkat in your wealth and family" and he has also said, "The compensation of a loan is thanks and paying it back." (Nasaai) Rather if the need is a pennissible one and the person asks for Qarz then giving the loan to him is Mustahab as this is helping another andAllah's aid is also attained through this. The delaying ofpayment by the debtor is also better for the creditor. Rassoollalah � has said, "The person who has a financial right over another and the latter delays the payment , then Thawaab of giving Sadqa equal to the money lent is attained for every day delayed." (lmaamAhmed) It is necessary when taking the Qarz, to have the intention ofpaying it back and if it cannot be repaid by the allotted time, then one should humbly and humanely apologize. It should not be evaded and put off unnecessarily as sin is incurred by this. The Noble Messenger � has stated, "After major sins which have been prohibited by Allah, there is no other sin more disastrous to Him than a person dying with a debt and not leaving anything behind to resolve it." (Ahmed) Rassoollalah � is reported to have said, "The affluent person who delays paying his loan, causes his respect and punishment to become Halaal ." (AbuDawood, Nasaai) Annotating on the above, Hazrat Abdullah bin Mubarak � states that the meaning of his respect becoming Halaal, is that he wil l be put into 278
