Rule- The expensiveness or cheapness ofan obj ect in fulfilling the Qarz is of no consequence, e.g., on the day of taking Qarz of 1 kg flour, it' s cost was low and on the day ofreturning it, i t increased then the increase is of no consequence. The same 1 kg flour must be returned. (Durre­ Mukhtaar) Rule- When the creditor makes Qabza on the object of Qarz, he becomes the Maalik ofit. (Durre-MukhtaQl; A lamghiri) Rule- When returning a qarz, if an extra amount is given but was not stipulated in the loan then it is permissible for the creditor to take it. {Dun·e-Mukhtawl Rule- If a loan is given and it is stipulated that an extra amount must be returned, then this i s usury and haraam. (A!amghiri) Rule- If the debtor sends a gift to the creditor then there is nothing wrong with him taking it ifthis gift is not given due to the debt. It should be abstained from if it is given due to Qarz. This is the same Hukm if given a Daawat. (Alamghin) Rule- Just as how the Shariah has made taking interest Haraam so too has it prohibited giving usury. The Ahadeeth have cursed both people who do and deemed them equal in sin. Riba (Interest) is Haraam and should not be taken or given byMuslims. MISCELLANEOUS MASAAIL Rule- Tying a knot of string around the finger in order to remember doing something is allowed but unnecessarily tying a knot is Makrooh. (Dun·e-Mukhtaar) Rule- Wearing aTa'weez (amul e t j . around the neck is pennissible , ifit is made up ofAyats of the Holy Quraan, the names ofAllah £ and other permissible writings. However, if impennissible writings, e.g. shirk, Kufr etc make up the Taweez or an unworthy person who does not 280
